Tina Beauté, a sole proprietorship registered under the French RNE number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 Mulhouse, France, operates a website through which it offers online products related to eye beauty and hair care.
These Terms & Conditions define the contractual relationship between Tina Beauté and its customers.
These Terms & Conditions apply, without restriction or reservation, to all sales of Beauty Services and/or Products offered by TINA BEAUTÉ on the website:

Offers are exclusively reserved for private consumers for personal use only and not for resale purposes.
A private consumer is a natural person acting for purposes outside their commercial, industrial, artisanal or professional activity.
Consequently, any person ordering Beauty Services and/or Products offered for sale on the website https://www.tinabeaute.fr/ or making a reservation for a Beauty Service fully accepts these Terms & Conditions, which the Buyer acknowledges having read prior to placing an order.
The Buyer is encouraged to carefully read, download, print and keep a copy of these Terms & Conditions.
Before placing an order, the Buyer acknowledges:

that any purchase made on https://www.tinabeaute.fr/ is unrelated to professional activity and strictly intended for personal use;

having full legal capacity to enter into these Terms & Conditions;

being of legal age and not under guardianship or legal protection.
TINA BEAUTÉ reserves the right to modify these Terms & Conditions at any time by publishing a new version applicable to any order placed after its publication on the website.
ARTICLE 1 — DEFINITIONS
Whenever the following terms appear in these Terms & Conditions with a capital letter, whether singular or plural, they shall have the following meaning:
TINA BEAUTÉ
Refers to Tina Beauté as described above and any person or entity acting on its behalf for sales on the website.
Buyer
Refers to any adult private consumer with legal capacity wishing to book Beauty Services or purchase Products available on https://www.tinabeaute.fr/ and accepting these Terms & Conditions.
Beneficiary
Refers to the person designated by the Buyer to receive the Beauty Services.
Order
Refers to any order of Products or Beauty Services placed through https://www.tinabeaute.fr/.
Client
Refers to the natural person declaring to be of legal age or the legal entity represented by a person authorized to act on its behalf, wishing to purchase one or more products sold by TINA BEAUTÉ.
Contract
Refers to the sales contract concluded through the website between the Client and TINA BEAUTÉ governed by these Terms & Conditions.
Product Sheet
Refers to the description of a Product including at minimum a product image, price in euros including taxes, and a description of its essential characteristics, including ingredients, function, precautions for use, nominal quantity and bottle size where applicable.
Beauty Services
Refers to the beauty services provided exclusively by Mrs. DO Thi Hien, owner of Tina Beauté, and available for booking on https://www.tinabeaute.fr/.
Party
Refers individually or collectively to the Client and/or TINA BEAUTÉ.
Personal Data
Refers to any information relating to a Buyer.
Products
Refers to products offered for sale on the website.

Refers to the website accessible at:

ARTICLE 2 — SCOPE
These Terms & Conditions apply to all sales concluded through the website https://www.tinabeaute.fr/.
ARTICLE 3 — CUSTOMER ACCOUNT
3.1 Customer account features
The customer account allows the Client to:

view order history and details,
-
return or exchange Products,
-
add or modify billing and delivery addresses,
-
manage email subscriptions,
-
manage personal information.
3.2 Account creation
To create a customer account, the Client must:

be a legal adult under applicable national law,
-
or be a legal entity represented by an authorized individual,
-
and have legal capacity to enter into a contract.
The Client agrees to provide accurate, truthful and complete information and not to use false identities or create accounts for third parties.
A password must be created to access the account.
3.3 Account access & security
Once the account is created, the Client receives a confirmation email containing login details.
The Client is responsible for maintaining the confidentiality of login credentials.
TINA BEAUTÉ may suspend or close an account in case of fraudulent or abusive use.
3.4 Account modification
The Client may modify or delete account information at any time.
ARTICLE 4 — ORDER PROCESS
4.1 Product orders
Clients may select Products from Product Sheets and add them to the cart before finalizing purchases.
4.2 Identification
Clients must either log into an existing account or create one before validating an order.
4.3 Delivery information
Before completing an order, the Client must:

validate the delivery method,
-
provide delivery information,
-
accept these Terms & Conditions.
4.4 Payment validation
Orders become final only after full payment.
TINA BEAUTÉ reserves the right to refuse an order in case of:

unpaid previous orders,
-
disputes,
-
or breach of these Terms & Conditions.
4.5 Confirmation email
A confirmation email including order summary, prices, delivery information and these Terms & Conditions is sent to the Client.
Invoices are issued in euros and VAT exempt under article 293 B of the French General Tax Code.
4.6 Archiving
For orders equal to or exceeding €120, TINA BEAUTÉ retains the electronic contract for 10 years in accordance with French consumer law.
ARTICLE 5 — BEAUTY SERVICES
5.1 Service characteristics
Beauty Services available on https://www.tinabeaute.fr/ are described with:

service name,

detailed description,
-
location,
-
price,
-
validity period,
-
and available appointment times.
5.2 Booking procedure
The Client selects the desired Beauty Service and requests a reservation through the website.
If the requested time slot is unavailable, alternative appointment times may be proposed.
A confirmation email containing:
-
reservation details,
-
appointment date and time,
-
Beneficiary information,
-
and order summary
is sent once the booking is confirmed.
A minimum deposit of €10, depending on the service, is charged during online booking confirmation. The remaining balance may be paid onsite on the appointment day.
The deposit amount is clearly indicated before payment and does not apply to cash payments.
5.3 Medical contraindications & client responsibility
Before any Beauty Service, the Client declares having no known medical contraindications.
Certain services such as:

eyelash extensions,
-
microblading,
-
or hair straightening
may cause reactions in cases of allergies, medical treatments, pregnancy, sensitive skin or dermatological conditions.
The Client agrees to inform TINA BEAUTÉ of any health condition or contraindication before the appointment.
TINA BEAUTÉ cannot be held liable for reactions resulting from undisclosed contraindications.
ARTICLE 6 — PRODUCT AVAILABILITY
Products and prices displayed on the website remain valid while visible online.
Availability depends on stock levels and supplier availability.
Clients are informed by email in case of unavailable products.
Pre-order products may have release dates modified by suppliers.
ARTICLE 7 — PRICES
Prices are displayed in euros (€), excluding shipping costs where applicable.
Prices may change without prior notice.
Orders are invoiced based on prices in effect at the time of order confirmation.
VAT not applicable under article 293 B of the French General Tax Code.
Custom duties or local taxes remain the recipient’s responsibility.
ARTICLE 8 — SHIPPING FEES
Shipping fees include preparation, packaging and postage costs.
Separate orders cannot be combined.
ARTICLE 9 — PAYMENT
Accepted payment methods include:

credit/debit cards,

PayPal,
-
bank transfer,
-
cash.
Payments are processed through secure providers such as SumUp, Stripe and PayPal.
No banking information passes through https://www.tinabeaute.fr/.
For onsite card payments of Beauty Service balances, an additional fixed €2 transaction fee applies. This fee is clearly indicated before payment and does not apply to cash payments.
TINA BEAUTÉ reserves the right to request a copy of an ID document for card payments.
ARTICLE 10 — DELIVERY
Home delivery is not available.
Ordered products must be collected at the selected click-and-collect location.
Clients are informed by email at each stage of order preparation and collection availability.
ARTICLE 11 — RESERVATION MODIFICATION
Reservations may be modified free of charge up to six (6) hours before the appointment.
Promotional reservations cannot be modified or refunded.
Failure to modify or cancel a reservation within the required timeframe means the service is considered validly provided even if the Client or Beneficiary does not attend.
ARTICLE 12 — WARRANTY — RETURNS — REFUNDS — WITHDRAWAL
Products sold by https://www.tinabeaute.fr/ are new and guaranteed against defects.
Clients have fifteen (15) business days from receipt to request an exchange or refund for defective or non-compliant products.
Returned products must be:
-
unused,
-
complete,
-
in original packaging,
-
accompanied by all accessories and proof of purchase.
Refunds are processed within fourteen (14) business days from receipt of returned items.
Return shipping costs remain the Client’s responsibility.
Cash-on-delivery returns are not accepted.
ARTICLE 13 — TRANSFER OF OWNERSHIP & RISK
Ownership transfers only after full payment.
Risk transfers upon delivery and receipt by the Buyer.
ARTICLE 14 — PERSONAL DATA PROTECTION
TINA BEAUTÉ is the owner and producer of all or part of the databases composing the website.
Website content and databases are legally protected.
Clients are prohibited from extracting, reproducing or reusing substantial parts of website databases.
ARTICLE 15 — LIABILITY
Product descriptions are based on supplier information.
TINA BEAUTÉ shall not be held liable for:

force majeure,
-
external websites,
-
supplier content,
-
legal restrictions applicable in delivery countries.
ARTICLE 16 — RIGHT OF WITHDRAWAL & BEAUTY SERVICE CANCELLATION
When a Beauty Service is booked more than fourteen (14) days in advance, the Buyer benefits from the legal withdrawal right.
When a Beauty Service is booked less than fourteen (14) days before the appointment, the Buyer expressly waives the withdrawal right under article L221-28 of the French Consumer Code.
Cancellation policy:

Free modification or cancellation up to 6 hours before appointment,
-
No cancellation or modification less than 6 hours before appointment,
-
No-show = 100% penalty.
Any delay reduces the effective treatment time without compensation.
ARTICLE 17 — PARTIAL INVALIDITY
If any provision of these Terms & Conditions is declared invalid, the remaining provisions remain fully enforceable.
ARTICLE 18 — NON-WAIVER
Failure by either Party to enforce any provision shall not constitute a waiver of future enforcement.
ARTICLE 19 — APPLICABLE LAW
These Terms & Conditions are governed by French law.
In case of translation discrepancies, the French version shall prevail.
ARTICLE 20 — CUSTOMER ACCEPTANCE
The Buyer expressly acknowledges having read and accepted these Terms & Conditions and pricing information before placing an order.
These Terms & Conditions may be modified at any time without prior notice by TINA BEAUTÉ.

General Terms & Conditions — Loyalty Program
TINA BEAUTÉ FOR YOU — LOYALTY PROGRAM
1. Introduction
Welcome to the Tina Beauté Loyalty Program.
Tina Beauté is a sole proprietorship registered under the French RNE number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 Mulhouse, France.
By becoming a member of the loyalty program, you agree to these Terms & Conditions.
2. Program Definition — Tina Beauté for You
2.1. “Tina Beauté for You” is a personalized loyalty program available on:
https://www.tinabeaute.fr/
For each booked beauty service appointment, members receive 1 reward point.
Once at least 10 reward points have been accumulated, members may benefit from a complimentary reward corresponding to a 50% discount on a future eyelash extension service, up to a maximum value of €80.
.2.2. The loyalty program applies exclusively to beauty services booked through:
https://www.tinabeaute.fr/
after deduction of any discounts or promotional offers.
3. Membership
3.1. Membership in the loyalty program is completely free and does not require any purchase.
3.2. If you are a new customer, you are automatically enrolled in the Tina Beauté for You program when creating your customer account.
3.3. If you are already a customer, the loyalty program is already available in your account.
Services completed before the launch of the loyalty program cannot be counted retroactively.
3.4. Membership is personal, non-transferable, and subject to compliance with these Terms & Conditions as well as any other rules, guidelines or policies established by Tina Beauté.
Only one membership is permitted per person and per registered email address.
3.5. Businesses, associations, groups, organizations or entities purchasing for commercial purposes or resale are not eligible for membership.
The loyalty program may not be used for resale or profit-making purposes.
3.6. Members are responsible for keeping their email address and contact information up to date.
4. Rewards
4.1. For each beauty service booked through the website, the member receives 1 reward point.
4.2. Reward points appear in the customer account only after:
-
the appointment has been completed,
-
and full payment has been received.
4.3. Once 10 reward points have been accumulated, the member may claim a 50% discount on their next eyelash extension appointment, up to a maximum discount value of €80.
The discount voucher will become available no later than one day after eligibility and remains valid for 12 months from its issuance date.
4.4. Discount vouchers:
-
cannot be exchanged for cash,
-
and cannot be used for purchases made in the online store section of https://www.tinabeaute.fr/
4.5. Each discount voucher:
-
may only be used once,
-
applies to a single service only,
-
and is automatically applied to the least expensive booked service when multiple services are booked simultaneously.
Japanese hair straightening, microblading and permanent lipstick services are excluded from the loyalty reward discount.
The maximum discount amount may not exceed €80.
4.6. Reward points and benefits are personal and cannot be transferred to another person or account.
4.7. Reward points may be removed from the customer account if:

the appointment is missed,
-
or the booked service has not been fully paid.
5. Reward Validity Period
Rewards remain valid for 12 months from the date the discount voucher is issued.
If the voucher is not used within this period, it automatically expires.
6. Limitation of Liability
Tina Beauté shall not be held liable for:

interruptions,
-
malfunctions,
-
temporary suspension,
-
modifications,
-
or termination of the loyalty program.
Tina Beauté excludes liability for any loss or damage related to the loyalty program except where liability cannot legally be excluded.
7. Partial Invalidity — Modification of Terms
If one or more provisions of these Terms & Conditions are declared invalid or unlawful, the remaining provisions shall remain fully enforceable.
Tina Beauté reserves the right to modify or adapt these Terms & Conditions at any time without prior notice.
Any modifications become applicable to all future use of the loyalty program after publication.
8. Disputes — Applicable Law — Jurisdiction
These Terms & Conditions are governed by French law.
Only the French version of the Tina Beauté for You Loyalty Program Terms & Conditions shall prevail in case of translation discrepancies.
Any dispute arising from the interpretation or execution of these Terms & Conditions shall fall under the jurisdiction of the competent French courts.

Referral Program Terms & Conditions
REFERRAL PROGRAM
1. Introduction
Welcome to the Tina Beauté Referral Program.
Tina Beauté is a sole proprietorship registered under the French RNE number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 Mulhouse, France.
By participating in this program, you agree to these Terms & Conditions.
2. Purpose
The referral program allows members to earn rewards in the form of discounts applicable to future beauty service bookings on:
https://www.tinabeaute.fr/
Members can refer friends to become new clients of Tina Beauté.
3. How the Referral Program Works
Referring members may receive a 10% discount if:
-
a referred friend books a service,
-
creates a valid Tina Beauté customer account in compliance with our Terms & Conditions,
-
attends the appointment,
-
and pays the full amount due for the service.
The referred friend will receive a 5% welcome discount applied during payment after the service has been completed.
4. Referred Friends
Referred friends who register on https://www.tinabeaute.fr/ will receive a 5% welcome discount applicable at checkout after their appointment.
This offer is limited to one discount per client and per email address.
Tina Beauté reserves the right to take corrective action, including:

deletion of accounts,
-
cancellation of orders or bookings,
-
refusal of benefits,
in cases of fraud, falsification, abuse, violation of these Referral Program Terms, General Terms & Conditions, payment conditions, or suspected technical misuse.
This offer is void where prohibited by applicable law.
If a purchase later qualifies for a refund, the maximum refundable amount will correspond only to the amount actually paid by the customer.
Referral discounts cannot be combined with:

other promotional offers,

discount codes,

or loyalty program rewards.
5. Multiple Referrals
A referred friend may benefit from only one welcome discount.
If a friend is referred by multiple members, only the first referring member associated with the referral will receive the 10% discount reward.
6. Limitation of Liability
Tina Beauté shall not be held liable for:

interruptions,

malfunctions,
-
temporary unavailability,
-
modifications,
-
suspension,
-
or termination of the referral program.
Tina Beauté excludes liability for any direct or indirect damages related to the referral program except where liability cannot legally be excluded.
