PREAMBLE
The sole proprietorship Tina Beauté, registered with the French National Business Register (RNE) under number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 MULHOUSE, operates a website through which it offers Beauty Services for sale.
These Terms and Conditions are intended to define the conditions under which the sales contract is concluded between Tina Beauté and its clients.
These Terms and Conditions of Sale apply, without restriction or reservation, to all Beauty Services sold by TINA BEAUTÉ through the website https://www.tinabeaute.fr/.
The offers are exclusively reserved for private consumers.
A consumer is a natural person acting for purposes that are outside their commercial, industrial, artisanal, or professional activity.
Consequently, any person placing an order or booking a Beauty Service on the website https://www.tinabeaute.fr/ fully and unreservedly accepts these Terms and Conditions of Sale and acknowledges having read them prior to placing an order.
The Client is invited to carefully read, download, print, and keep a copy of these Terms and Conditions.
Prior to placing an order, the Client acknowledges that:

any purchase made on the website https://www.tinabeaute.fr/ is unrelated to their professional activity and is strictly intended for personal use;

they have full legal capacity to enter into these Terms and Conditions of Sale, are of legal age, and are not under guardianship or legal protection at the time of placing the order.
TINA BEAUTÉ reserves the right to modify these Terms and Conditions at any time by publishing a new version online. The applicable Terms and Conditions are those in force at the date of the order.
ARTICLE 1 - DEFINITIONS
Whenever the following terms appear in these Terms and Conditions, whether singular or plural and beginning with a capital letter, they shall have the following meanings:
TINA BEAUTÉ: refers to the company Tina Beauté as described in the preamble, as well as any natural or legal person replacing it for the sale of services on the Website.
Buyer / Client: refers to any adult consumer with legal capacity wishing to book a Beauty Service available on the website https://www.tinabeaute.fr/ and accepting these Terms and Conditions of Sale.
Beneficiary: refers to the person designated by the Buyer at the time of booking who will receive the Beauty Services.
Order: refers to any order for Beauty Services placed through the website https://www.tinabeaute.fr/.
Contract: refers to the sales contract concluded through the Website between the Client and TINA BEAUTÉ and governed by these Terms and Conditions.
Beauty Services: refers to all beauty services provided exclusively by Mrs. DO Thi Hien, owner of Tina Beauté, and available for booking on the website https://www.tinabeaute.fr/.
Party: refers individually or collectively to the Client and/or TINA BEAUTÉ.
Personal Data: refers to any information relating to a Client.
Website: refers to the website accessible at https://www.tinabeaute.fr/.
ARTICLE 2 - SCOPE OF APPLICATION
These Terms and Conditions apply to all sales concluded through the website https://www.tinabeaute.fr/.
ARTICLE 3 - CUSTOMER ACCOUNT
3.1 The Customer Account allows the Client to:

view order history and details;

add or modify billing information;

manage email subscriptions;

manage personal information.
3.2 Creation of a Customer Account
To create a customer account, the Client must be a legal adult and legally capable of entering into a contract.
The Client undertakes to provide accurate, sincere, and complete information and agrees not to create an account on behalf of a third party or allow a third party to use their account.
The Client must create a personal password and ensure its confidentiality.
3.3 Use of the Customer Account
The Client must immediately inform TINA BEAUTÉ if fraudulent use of their account is suspected.
Each Client may only hold one customer account.
Failure to comply with these provisions may result in suspension or deletion of the account by TINA BEAUTÉ.
3.4 Modification or Deletion
The Client may modify or delete the information contained in their customer account at any time.
ARTICLE 4 - BEAUTY SERVICES
4.1 Characteristics
The Client may book the Beauty Services offered on the website https://www.tinabeaute.fr/.
It is the Client’s responsibility to review all characteristics of the Beauty Services before booking, including:

the name of the service;

the service description;
-
the price;
-
the duration;
-
available booking times;
-
the establishment where the service is provided.
4.2 Purchase – Booking
The Client submits a booking request through the booking module available on the Website.
If the requested Beauty Services are unavailable at the chosen date and time, alternative availabilities may be offered.
The booking only becomes effective after availability has been confirmed and a confirmation email has been sent.
The Client will receive a booking confirmation email including:

the date;

the time;
-
the beneficiary’s name;
-
the essential details of the order.
A deposit, the amount of which varies depending on the service booked, is charged by TINA BEAUTÉ at the time of booking confirmation on the Website.
The exact amount of the deposit is clearly indicated before payment validation.
The remaining balance may be paid on-site on the day of the appointment.
Beauty Services are limited to the services offered on the website https://www.tinabeaute.fr/.
4.3 Medical Contraindications and Client Responsibility
Before any Beauty Service, the Client declares that they are not aware of any medical contraindications.
Certain services, such as eyelash extensions, microblading, or Japanese hair straightening, may cause reactions in the event of allergies, medical treatments, or specific conditions (pregnancy, sensitive skin, dermatological treatment, etc.).
By booking a Beauty Service, the Client acknowledges having been informed of these potential risks and undertakes to inform TINA BEAUTÉ of any medical history or condition that could affect the service.
TINA BEAUTÉ cannot be held liable for reactions or damage resulting from a failure by the Client to disclose such information or from undisclosed contraindications.
ARTICLE 5 - PRICES
Prices are indicated in euros and are net amounts.
All orders are invoiced and payable in euros.
VAT not applicable pursuant to Article 293 B of the French General Tax Code.
TINA BEAUTÉ reserves the right to modify prices at any time.
ARTICLE 6 - PAYMENT
The Client has access to several secure payment methods:

bank card;

PayPal;
-
bank transfer;
-
cash.
Payments are processed through the secure servers of TINA BEAUTÉ’s payment partners (Stripe, SumUp, PayPal).
No banking information passes through the website https://www.tinabeaute.fr/.
Card payments are fully secure.
ARTICLE 7 - MODIFICATION OR CANCELLATION OF BOOKINGS
Any booking may be modified or cancelled through the Website or by contacting TINA BEAUTÉ, subject to the strict conditions and deadlines defined in Article 8 of these Terms and Conditions.
Bookings made as part of a promotion or discounted rate are neither modifiable nor refundable.
The Client will receive an email confirmation in the event of a validated modification.
ARTICLE 8 - WITHDRAWAL RIGHTS AND CANCELLATION CONDITIONS
8.1 Absence of Right of Withdrawal
In accordance with Article L.221-28 12° of the French Consumer Code, the right of withdrawal does not apply to services provided on a specific date or within a specified period.
Consequently, bookings for Beauty Services made for a specific date and time do not benefit from any legal right of withdrawal.
The booking becomes final upon validation of the order and payment of the deposit.
8.2 Cancellation and Modification Conditions
In order to preserve appointment organization and respect subsequent appointments, TINA BEAUTÉ authorizes booking modifications or cancellations according to the following conditions:

Up to 6 hours before the appointment
The Client may modify or cancel the booking free of charge via their customer account or by contacting TINA BEAUTÉ.
The deposit paid may then be refunded or converted into a credit.

Less than 6 hours before the appointment
As each appointment slot is reserved exclusively for the Client, a late cancellation generally prevents another booking from being scheduled.
No modification or cancellation will be possible.
The deposit paid will remain the property of TINA BEAUTÉ as fixed compensation for the reserved appointment slot.

Promotional Services
Any service purchased as part of a promotion or discounted rate is neither modifiable nor refundable.
8.3 No-show and Delays

No-show
If the Client or Beneficiary fails to attend the appointment without cancelling under the above conditions, the deposit paid shall remain the property of TINA BEAUTÉ.

Delays
Any delay by the Client will be deducted from the treatment time in order not to impact subsequent appointments.
The Client shall not be entitled to any refund, price reduction, or compensation if the service is shortened due to their delay.
ARTICLE 9 - PERSONAL DATA
The information collected by TINA BEAUTÉ is necessary for managing bookings, payments, customer accounts, and communication with Clients.
Personal data is processed in accordance with applicable data protection regulations (GDPR).
The Client has the right to access, rectify, object to, delete, and restrict the processing of their personal data.
Any request relating to personal data may be sent to TINA BEAUTÉ using the contact details available on the Website.
ARTICLE 10 - PARTIAL INVALIDITY
If one or more provisions of these Terms and Conditions are declared invalid or unenforceable by law, regulation, or final court decision, the remaining provisions shall remain fully valid and enforceable.
ARTICLE 11 - NO WAIVER
The failure of either party to invoke a breach by the other party of any obligation under these Terms and Conditions shall not be interpreted as a waiver of that obligation in the future.
ARTICLE 12 - APPLICABLE LAW
These Terms and Conditions are governed by French law.
They are written in French.
In the event of translation into another language, only the French version shall prevail in the event of a dispute.
ARTICLE 13 - CLIENT ACCEPTANCE
These Terms and Conditions of Sale, together with the pricing, are expressly accepted by the Client, who acknowledges having read them before making any booking.
TINA BEAUTÉ reserves the right to modify its Terms and Conditions at any time.
The applicable Terms and Conditions are those in force on the date of the booking or order.

ARTICLE 14 - CONSUMER MEDIATION
In the event of a dispute between the Client and the company, both parties shall endeavor to resolve the matter amicably.
Failing an amicable agreement or in the absence of a response within a reasonable period of one (1) month, the consumer Client may refer the matter free of charge to the competent consumer mediator:

TINA BEAUTÉ FOR YOU — LOYALTY PROGRAM
1. Introduction
Welcome to the Tina Beauté Loyalty Program.
Tina Beauté is a sole proprietorship registered under the French RNE number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 Mulhouse, France.
By becoming a member of the loyalty program, you agree to these Terms & Conditions.
2. Program Definition — Tina Beauté for You
2.1. “Tina Beauté for You” is a personalized loyalty program available on:
https://www.tinabeaute.fr/
For each booked beauty service appointment, members receive 1 reward point.
Once at least 10 reward points have been accumulated, members may benefit from a complimentary reward corresponding to a 20% discount on a future eyelash extension service, up to a maximum value of €80.
.2.2. The loyalty program applies exclusively to beauty services booked through:

after deduction of any discounts or promotional offers.
3. Membership
3.1. Membership in the loyalty program is completely free and does not require any purchase.
3.2. If you are a new customer, you are automatically enrolled in the Tina Beauté for You program when creating your customer account.
3.3. If you are already a customer, the loyalty program is already available in your account.
Services completed before the launch of the loyalty program cannot be counted retroactively.
3.4. Membership is personal, non-transferable, and subject to compliance with these Terms & Conditions as well as any other rules, guidelines or policies established by Tina Beauté.
Only one membership is permitted per person and per registered email address.
3.5. Businesses, associations, groups, organizations or entities purchasing for commercial purposes or resale are not eligible for membership.
The loyalty program may not be used for resale or profit-making purposes.
3.6. Members are responsible for keeping their email address and contact information up to date.
4. Rewards
4.1. For each beauty service booked through the website, the member receives 1 reward point.
4.2. Reward points appear in the customer account only after:

the appointment has been completed,
-
and full payment has been received.
4.3. Once 10 reward points have been accumulated, the member may claim a 20% discount on their next eyelash extension appointment, up to a maximum discount value of €80.
The discount voucher will become available no later than one day after eligibility and remains valid for 12 months from its issuance date.
4.4. Discount vouchers:

cannot be exchanged for cash,
-
and cannot be used for purchases made in the online store section of https://www.tinabeaute.fr/
4.5. Each discount voucher:
-
may only be used once,
-
applies to a single service only,
-
and is automatically applied to the least expensive booked service when multiple services are booked simultaneously.
Japanese hair straightening, microblading and permanent lipstick services are excluded from the loyalty reward discount.
The maximum discount amount may not exceed €80.
4.6. Reward points and benefits are personal and cannot be transferred to another person or account.
4.7. Reward points may be removed from the customer account if:

the appointment is missed,
-
or the booked service has not been fully paid.
5. Reward Validity Period
Rewards remain valid for 12 months from the date the discount voucher is issued.
If the voucher is not used within this period, it automatically expires.
6. Limitation of Liability
Tina Beauté shall not be held liable for:

interruptions,
-
malfunctions,
-
temporary suspension,
-
modifications,
-
or termination of the loyalty program.
Tina Beauté excludes liability for any loss or damage related to the loyalty program except where liability cannot legally be excluded.
7. Partial Invalidity — Modification of Terms
If one or more provisions of these Terms & Conditions are declared invalid or unlawful, the remaining provisions shall remain fully enforceable.
Tina Beauté reserves the right to modify or adapt these Terms & Conditions at any time without prior notice.
Any modifications become applicable to all future use of the loyalty program after publication.
8. Disputes — Applicable Law — Jurisdiction
These Terms & Conditions are governed by French law.
Only the French version of the Tina Beauté for You Loyalty Program Terms & Conditions shall prevail in case of translation discrepancies.
Any dispute arising from the interpretation or execution of these Terms & Conditions shall fall under the jurisdiction of the competent French courts.

Referral Program Terms & Conditions
REFERRAL PROGRAM
1. Introduction
Welcome to the Tina Beauté Referral Program.
Tina Beauté is a sole proprietorship registered under the French RNE number 841 081 722, whose registered office is located at 31 Avenue de Colmar, 68200 Mulhouse, France.
By participating in this program, you agree to these Terms & Conditions.
2. Purpose
The referral program allows members to earn rewards in the form of discounts applicable to future beauty service bookings on:

Members can refer friends to become new clients of Tina Beauté.
3. How the Referral Program Works
Referring members may receive a 10% discount if:

a referred friend books a service,
-
creates a valid Tina Beauté customer account in compliance with our Terms & Conditions,

attends the appointment,
-
and pays the full amount due for the service.
The referred friend will receive a 5% welcome discount applied during payment after the service has been completed.
4. Referred Friends
Referred friends who register on https://www.tinabeaute.fr/ will receive a 5% welcome discount applicable at checkout after their appointment.
This offer is limited to one discount per client and per email address.
Tina Beauté reserves the right to take corrective action, including:

deletion of accounts,
-
cancellation of orders or bookings,
-
refusal of benefits,
in cases of fraud, falsification, abuse, violation of these Referral Program Terms, General Terms & Conditions, payment conditions, or suspected technical misuse.
This offer is void where prohibited by applicable law.
If a purchase later qualifies for a refund, the maximum refundable amount will correspond only to the amount actually paid by the customer.
Referral discounts cannot be combined with:

or loyalty program rewards.
5. Multiple Referrals
A referred friend may benefit from only one welcome discount.
If a friend is referred by multiple members, only the first referring member associated with the referral will receive the 10% discount reward.
6. Limitation of Liability
